The petitioners apprehend their arrest in a case under Section 341, 323, 354, 504, 120(B) of the Indian Penal Code and section 3 (i) (x) (xi) of the SC/ST Act.

The complainant alleged that all the accused persons abused and assaulted the complainant and also tried to outrage her modesty.

It is submitted that prior to lodging of this case the complainant lodged complaint case No. 868 of 2009 and she claims to be wife of Sukhdeo Yadav. The petitioners are sons,

Patna High Court Cr.Misc. No.51228 of 2015 (2) dt.08-12-2015 2/2 wife and grand sons of Sukhdeo Yadav. The complainant claimed that Sukhdeo Yadav solemnized second marriage with her. The complaint petition was dismissed thereafter the complainant filed this case claiming herself to be wife of Nanhak Paswan. Considering the facts aforesaid and the nature of allegations made against the petitioners, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Gaya in SC/ST P.S. Case No. 39 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
