====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER ---------------- 11-12-2015 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Rajepur P.S. Case No.49 of 2015 registered under Sections 304(B) and 201/34 of the Indian Penal Code.

There is allegation that all the accused persons including the petitioners committed the murder of the deceased, the daughter of the informant, for non fulfillment of the dowry demand. Learned counsel appearing on behalf of the petitioners submits that it would appear from the complaint petition , which is the basis of the present F.I.R., that for the occurrence dated

Patna High Court Cr.Misc. No.50879 of 2015 (3) dt.11-12-2015 2/2 13.12.2014, the complainant/informant lodged this case on 30.03.2015. The petitioner no.2 is the son of the petitioner no.1 and they are not the family members or relatives of the son-in-law of the informant. The only allegation against the petitioners is that on made query by the informant, they asked the informant to provide the cash and motorcycle as demanded by her son-in-law for the safety of his daughter. Except that, there is nothing against the petitioners to connect them in the commission of the alleged offence.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender within four weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sikrahana, East Champaran, Motihari, in connection with Rajepur P.S. Case No.49 of 2015, subject to the conditions laid down under Section 438(2) Cr. P.C.
