The petitioner seeks bail in connection with Laukariya P.S. Case No. 37 of 2016 registered under Section 47(A) of the Excise Act.

It is submitted by the learned counsel for the petitioner that the alleged recovery of 2.5 liters alcohol is not from the conscious possession of the petitioner. The recovery was from the joint house which was abandoned by the family members since long.

Regard being had to the nature of allegation, the petitioner Rama Shankar Chaudhary, who is in custody since 28th June, 2016, is directed to be released on bail on furnishing bail

Patna High Court Cr.Misc. No.35357 of 2016 (2) dt.22-08-2016 2/2 bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Bagaha, West Champaran in connection with Laukariya P.S. Case No. 37 of 2016.
