Petitioner is languishing in judicial custody since 03.05.2017 in connection with Madhepura P.S. Case No. 228 of 2017, CIS No. 732 of 2017 for offences punishable under Section 30(a) of Bihar Prohibition and Excise Act, 2016 and Section 25(16) a, 26 of the Arms Act. The prosecution case, as lodged by the Excise SubInspector is that the house of the petitioner was raided and 800 ml. country made liquor and one country made pistol were recovered and accordingly, seizure list was prepared.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.32508 of 2017 (3) dt.18-08-2017 petitioner that he is innocent, bears no criminal antecedent and has voluntarily surrendered before the police. He submits that nothing incriminating has been recovered from his conscious possession and that he has been falsely implicated in this case. However, learned APP for the State opposes the prayer for bail.
Considering the facts and circumstances and the materials on record, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Madhepura, in connection with Madhepura P.S. Case No. 228 of 2017, CIS No. 732 of 2017.
