JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 03/ 22.06.2018 Heard learned counsel for the petitioner as well as learned counsel for the CBI.

Petitioner apprehends his arrest in connection with RC case no. 23A/2015 registered under sections 420, 468, 471 of the IPC and section 13 (2) read with section 13(I) (d) of the Prevention of Corruption Act.

Admittedly, petitioner is an employee of Raj Nandani Projects Private limited and accusation against him is that he submitted certain documents forging signature of the Managing Director of M/s Raj Nandani Projects Private limited.

Submission on behalf of the petitioner is that the

Patna High Court Cr.Misc. No.29046 of 2018 (3) dt.22-06-2018 above stated documents were submitted on behalf of the Managing Director of M/s Raj Nandani Projects Private limited and the Managing Director of the aforesaid company has not challenged the signature. It is further submitted that the Managing Director of M/s Raj Nandani Projects Private limited has already been admitted to anticipatory bail by a coordinate bench of this court vide order dated 6.2.2018 passed in Cr. Misc. no. 6534/2018 and the case of the petitioner is on better footing to the case of the Managing Director of the above stated company who was going to get benefited from the project.

Considering the aforesaid facts and circumstances as well as submissions of the parties, it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge, CBI-I, Patna in RC case no. 23A/2015 subject to condition as laid down under section 438(2) of the Cr.P.C.
