The petitioner seeks bail in a case registered for the offence under Sections 8, 20(b)(ii)(c), 24, 25 & 29 of the N.D.P.S. Act.

On a secret information, a raid was conducted and petitioner, who was driver of the container truck, was arrested on the spot and on search of container, total 8 quintal 100 gm. of Ganja was recovered.

It is submitted on behalf of petitioner that nothing has been recovered from the conscious possession of petitioner and the alleged recovery has been effected near the poultry farm of Amarnath Rai. Petitioner, being driver, was not aware about nature of consignment and he was made accused only on suspicion. Petitioner is in custody since 03.02.2021, having no criminal antecedent.

Patna High Court CR. MISC. No.1010 of 2022(3) dt.25-04-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that huge quantity of Ganja has been recovered from the container and petitioner is driver of the said container.

Considering the recovery of huge quantity of Ganja and the restriction imposed under Section 37 of the N.D.P.S. Act, the prayer for bail of petitioner is rejected. (Prabhat Kumar Singh, J) anay/- U T
