1. Heard learned counsel for the petitioner and learned A.P.P. for the State, Mr. Chandra Bhushan Prasad.
2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 75, 352, 351(3) and 3(5) of the BNS, 2023 read with Section 8 and 12 of the POCSO Act.
3. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and is a young boy
2/4 aged about 22 years and the informant alleges that while she was returning from coaching along with her friend, when petitioner intercepted her at 10:00 AM on 20.08.2024 and touched her at inappropriate places, on protest, the petitioner abused and assaulted her, further threatened that he will kidnap her accordingly, she raised an alarm when Hira, Rajesh and Munna came and petitioner fled.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that informant was coming along with her friend from coaching when the occurrence is alleged to have taken place. It is next submitted that petitioner and the informant are known to each other, but then on account of dispute, an altercation had taken place when the instant FIR came to be instituted. It is also submitted that had the petitioner any intention of committing an occurrence, in that event he would not have met the informant at 10:00 AM in the morning. It is next submitted that petitioner is a young boy aged about 22 years and in the nature of allegation as alleged, if he is sent to judicial custody, his entire career would get jeopardized and chances are bright that he may come in
3/4 contact with hardened criminals. It is next submitted that petitioner will not abscond rather will cooperate in the investigation to prove his innocence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Haspura P.S. Case No. 250 of 2024 subject to the conditions as laid down under Section 482 (2) of BNSS.
7. However, it is made clear that in the event if the Investigating Officer of the case files an application before the learned Trial Court bringing to its notice that petitioner despite giving assurance to this Court is not co-operating in the investigation, in that event the learned Trial Court shall be at liberty to cancel the bail bonds of the petitioner.
8. Let a copy of this order be sent to the concerned
4/4 police station through the learned Trial Court.
9. Accordingly, the instant anticipatory bail application stands allowed.
