2. The present petition has been filed for the following relief :- (i) For issuance of writ in the nature of mandamus commanding and directing the Respondents authority to hold an enquiry with regard to taking illegal work from the Respondent No. 9 despite of the knowledge that the appointment of the Respondent No. 9 has already been cancelled vide letter dated 28.4.2014.

(ii) For further direction to the Respondents authority to issue appointment letter to the petitioner who has secured highest percentage of marks and was placed in the merit list at serial no. 1 for appointment on the post of Vikas Mitra under Nagar Parishad, Mokama.

Patna High Court CWJC No.3801 of 2018(3) dt.22-09-2023 2/2 (iii) For further direction to the Respondents authority to take appropriate action against the Executive Officer, Nagar Parishad, Mokama as well as the Block Development Officer, Mokama who in connivance with each other has allowed to continue the Respondent No. 9 to work as a Vikas Mitra having full knowledge that the engagement of the Respondent No. 8 has already been cancelled and illegally and arbitrarily has deprived the petitioner from appointment letter and has caused mental harassment.

3. Learned counsel for the petitioner submits that it will suffice that the D.M. who is the ultimate authority considers his case and after hearing all the parties pass necessary order.

4. In view of the said submission put forward by learned counsel for the petitioner, having no objection from the respondent authorities, the writ petition stands disposed of with a direction to the petitioner to file representation within six weeks from today before the D.M. Patna.

5. In case such representation is filed, the same shall be considered and a reasoned order be passed after hearing all the necessary parties within a period of four months from the filing of the representation.

6. With the aforesaid observation and direction, this writ petition stands disposed of.
