Petitioner, who is in custody, seeks bail in a case, registered for the offence punishable under Section 363 of the Indian Penal Code and subsequently Section 364A of the Indian Penal Code has been added.

Allegation against the accused persons including the petitioner is to have kidnapped the son of the informant for the purpose of the ransom.

It has been submitted on behalf of the petitioner that he is innocent and has falsely been implicated in this case. The petitioner has no criminal antecedent and he is in custody since since 04.07.2019.

Learned A.P.P. appearing for the State opposes the

Patna High Court CR. MISC. No.59987 of 2019(3) dt.27-11-2019 2/2 prayer of bail of the petitioner and submits that there is sufficient evidence/material against the petitioner regarding kidnapping the boy for the purpose of ransom. He further submits that the police party has rescued the victim on the disclosure of co-accused.

Considering the facts and circumstances of the case and nature of allegation, I am not inclined to enlarge the petitioner on bail. Hence, the prayer for bail of the petitioner is hereby rejected.

However, the court below is directed to expedite the trial and conclude the same within one year from the date of receipt of the order.
