2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 65 and 139 of the Bhartiya Nyaya Sanhita and Sections 4 and 6 of the POCSO Act.
3. The case of the prosecution is that three years' daughter of the informant was missing after that they dialed 112 for informing the police. The daughter was found near Panchana river in Nardiganj block and her mouth was tapped
Patna High Court CR. MISC. No.68547 of 2024(4) dt.29-01-2025 2/3 and she was bleeding. The FIR was lodged against unknown miscreants.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case. He is brother-in-law of the informant and he was sleeping on that day in their house. He further submitted that the the name of the petitioner has surfaced in this on the basis of suspicion by police. A statement has been made in para-3 of this petition that the petitioner has got no criminal antecedent. Moreover, he is languishing in judicial custody since 04.07.2024.
5. Learned counsel for the informant has submitted that parties have compromised this case and it has also been brought to notice of this Court that during evidence, the informant has not implicated the petitioner.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Mahila P.S. Case No. 27 of 2024 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District
