2. In the present case, the petitioner seeks bail in connection with Neemchak Bathani P.S. Case No. 91 of 2024, registered for the offences under Sections 341, 323, 307, 504, 506 and 34 of the Indian Penal Code and Section 27 of the Arms Act.
3. As per the prosecution case, in the background of land dispute the petitioner and other co-accused persons surrounded the informant and his brother and abused and assaulted them. The co-accused Vinod Yadav shot at the brother of the informant and the shot hit in the finger of the brother of the informant.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.67098 of 2025(2) dt.04-11-2025 2/3 petitioner submits that petitioner is innocent and has been falsely implicated in this case. There is nothing to show the involvement of the petitioner in the present occurrence. Land dispute is admitted between them. There is no allegation against the petitioner for opening fire as well as the co-accused Vinod Yadav who had been granted bail by this Court vide Order dated 11.12.2024 passed in Cr. Misc. No. 84880 of 2024. The petitioner has no criminal antecedent and is in custody since 11.05.2025. The charge-sheet has been submitted.
5. Learned A.P.P. appearing for the State opposes the submission made on behalf of the petitioner.
6. Having regard to the fact and circumstances and submission made on behalf of the parties and considering the clean antecedent of the petitioner, period of custody and submission of charge-sheet, the petitioner is directed to be released on bail, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate - 1st Class, Gaya in connection with Neemchak Bathani P.S. Case No. 91 of 2024, subject to the condition laid down under Section 480(3) of the BNSS and other following conditions: (i) One of the bailors will be a close

(ii) The petitioner will remain present on each and every date fixed by the court below, if so required by the learned trial court.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
