The petitioners apprehend their arrest in Powakhali P.S. Case No.35 of 2019, registered under Sections 147, 149, 341, 323, 332, 353, 504 and 506 of the Indian Penal Code. The informant disclosed that one truck bearing Registration No.BR-11GA-4711 loaded with sand was intercepted. The D.T.O. imposed fine but while the police officials were taking the truck to the police station, the truck driver and owner of the truck forcibly got down the police officials from the truck and fled away. Again the D.T.O. and police officials intercepted the truck. On such the villagers made protest and blocked the road. Learned counsel for the petitioners submits that without any specific allegation, the petitioners have been made accused in
Patna High Court CR. MISC. No.58499 of 2019(2) dt.19-09-2019 2/2 the case. Similarly situated four other accused persons, namely, Akbar @ Bhuttu @ Akbar Ali, Azad @ Md. Azad, Sanjay Singh @ Sanjay Kumar Singh and Rashid @ Abdul Rashid have been granted anticipatory bail by a coordinate Bench of this Court vide order dated 09.08.2019, passed in Cr. Misc. No.49980 of 2019. Taking into consideration the facts aforesaid and the fact that similarly situated co-accused have already been granted anticipatory bail, let petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, I, Kisanganj in connection with Powakhali P.S.
