1. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
2. This application for grant of anticipatory bail arises out of Alamganj Police Station Case No. 644 of 2020, dated 21.10.2020, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2018 (hereinafter referred to as 'the Act').
3. The prosecution story, as per the First Information Report, the police, on secret information, reached Meena Bazar, where illicit liquor was being sold. On seeing the police, the accused persons fled away, and during search, a white plastic bag was found containing 176.499 liters of country-made illicit liquor.
4. Learned counsel for the petitioner submits that the petitioner is having clean antecedent and has not
Patna High Court CR. MISC. No.62207 of 2025(2) dt.24-09-2025 2/3 committed any offence in the manner alleged. The petitioner has been made accused on the basis of secret information. He next submits that illicit liquor has not been recovered from the conscious possession and from perusal of the seizure list it would be evident that illicit liquor has been recovered from trash in the market of Meena Bazar which is open space and is accessible to all and sundry. He further submits that similarly situated coaccused person, namely, Kallu Ram @ Kallu Dome, has been granted bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 12633 of 2025.

Regards being had to the submission made by the parties and taking into consideration the fact that the petitioner is not having any criminal antecedent, illicit liquor has not been recovered from his conscious possession and similarly situated co-accused person has been granted anticipatory bail by a Co-ordinate Bench of this Court, I am inclined to grant the petitioner privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioner, above named, in the event of his arrest or surrender before the Court below within four weeks, be

No.62207 of 2025(2) dt.24-09-2025 3/3 released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court of Excise, Patna City, in connection with Alamganj Police Station Case No. 644 of 2020, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
