1. Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
2. This application for grant of anticipatory bail arises out of Alamganj Police Station Case No. 131 of 2021, dated 25.02.2021, disclosing offence under Section 30(a) of the Bihar Prohibition and Excise Act.
3. The prosecution story, as per the First Information Report, the police, on secret information, reached at the place of occurrence at Meena Bazar, Dome Khana and upon seeing the police party, the petitioners, along with other co-accused persons, managed to escape. During search, a jute bag was recovered from near the common public
Patna High Court CR. MISC. No.62421 of 2025(2) dt.24-09-2025 2/3 toilet containing a total of 115 litres of illicit countrymade liquor.
4. Learned counsel for the petitioner submits that the petitioners have not committed any offence in the manner alleged and they have been made accused on the basis of secret information. He next submits that illicit liquor has not been recovered from the conscious possession of the petitioners and/or premises belonging to them and from perusal of the seizure list it would be evident that illicit liquor has been recovered from near the common public toilet which is open space and is accessible to all and sundry. He further submits that similarly situated coaccused persons, namely Shrawan Dom and Kamlesh Dom @ Kamlesh Ram, have been granted anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 68361 of 2022 and Cr. Misc. No. 33705 of 2022.

Regards being had to the submission made by the parties and taking into consideration the fact that illicit liquor has been recovered from near the common public toilet which is open space and is accessible to all and sundry and similarly situated co-accused persons have been granted anticipatory bail by a Co-ordinate Bench of this Court, I
Patna High Court CR. MISC. No.62421 of 2025(2) dt.24-09-2025 3/3 am inclined to grant the petitioners privilege of anticipatory bail.
6. This application is, accordingly, allowed.
7. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Exclusive Special Court of Excise, Patna, in connection with Alamganj Police Station Case No. 131 of 2021, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
