The petitioner has renewed his prayer for bail in a case registered under sections 307, 147, 148, 149, 323, 341 and 504 of the Indian Penal Code and section 27 of the Arms Act. As per the prosecution case, the petitioner is said to have fired on the uncle of the informant leading to serious injuries.
It is submitted by learned counsel for the petitioner that the earlier prayer for bail of the petitioner was rejected vide order dated 4.4.2022 (Annexure-1) passed in Cr. Misc. no. 51420 of 2021. It is further submitted that in a case under section 307 of the Indian Penal Code the petitioner is in custody since 7.5.2021 and there is no progress whatsoever in the
Patna High Court CR. MISC. No.62173 of 2022(3) dt.14-12-2022 2/2 learned trial Court in so far as, as per the last instruction received even charge has not been framed. The petitioner undertakes to cooperate in the trial.
Heard learned AP.P for the State.
A report was called from from the learned trial Court. As per the report received contained in letter dated 30.11.2022 the case is fixed on 14.12.2022 ie today for framing of charge. Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case together with the petitioner having remained in custody since 7.5.2021 and investigation in the case having concluded, the petitioner is directed to be enlarged on bail in connection with Danapur P.S. Case no. 336 of 2021 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J-V, Danapur District Patna.
