2. The petitioners are in custody in connection with Jamui P.S Case No. 363 of 2020 instituted for the offence punishable under Sections 341, 323, 379, 307 and 504/34 of the

Patna High Court CR. MISC. No.67403 of 2024(2) dt.18-01-2025 2/3 Indian Penal Code and Section 27 of the Arms Act.

3. It is a case of shot fired upon the informant by petitioner Neeraj Singh as a result of which he sustained injury on his shoulder and hand and the co-accused persons also snatched a mobile phone of the son of the informant.

4. Learned counsel for the petitioners submits that petitioners have falsely been implicated in this case. He next submits that the deposition of the informant, namely, Charitar Mahto (PW-1) has deposed before the trial Court that some unknown persons who were not the resident, namely, Charitar Mahto (PW-1) has deposed before the trial Court that some unknown persons who were not the resident of his village and he has also stated that shots were fired from unknown persons and the informant has not named this petitioner in his deposition and co-accused, namely, Ramesh Singh has been granted regular bail by the learned ADJ-II, Jamui in Sessions Trial No.88 of 2022 vide order dated 02.08.2023. Petitioners are in custody since 05.02.2024. He next submits that similarly situated coaccused has been granted regular bail by this Court passed in Cr. Misc. No. 79802 of 2023.

5. Learned APP for the State opposes the prayer for bail of the petitioners.

Considering the facts and circumstances of the case, submission of the petitioners and also the fact that similarly situated co-accused person has already been granted bail by this Court, let the petitioners above named be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Jamui in Sessions Trial No. 223 of 2024 arising out of Jamui P.S. Case No. 363 of 2020.
