Petitioner apprehends arrest in a case registered for the offence punishable under section 341, 342, 307, 323, 34 of I.P.C and 27 Arms Act.

As per the prosecution case, informant alleged that while he was going to the Malma village, all the F.I.R named accused persons including this petitioner assaulted the informant with slaps and also shot fire on panjra of the informant. The petitioner is the brother of Malti Kumari, with whom the informant is in love.

It is submitted that the petitioner is innocent and has falsely been implicated in this case. This case has been filed only with a view to save skin from Tarapur P.S. Case No. 196 of

Patna High Court CR. MISC. No.1699 of 2023(2) dt.19-06-2023 2/2 2021 which was lodged by the sister of the petitioner namely Matli Devi against the informant.

Learned counsel for the State opposes the prayer for bail and submits that there is direct and specific allegation against the petitioner is that he fired on the left side of the chest of the informant and due to which he sustained punctured wound.

Considering the nature and gravity of allegation against the petitioner that he made bullet injury to the vital part of the body of the informant, prayer for pre-arrest bail of the petitioner is rejected.
