The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, the four named accused persons including the petitioner herein as also one Ayush Kumar are said to have resorted to firing as a result of which injury was sustained by the informant in his leg.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case. No such occurrence as alleged in the FIR took place. The manner of occurrence is other than what has been narrated therein. Injury

Patna High Court CR. MISC. No.759 of 2022(2) dt.08-06-2022 2/2 on the informant has been found to be simple in nature. The case of the petitioner who is in custody since 14.9.2021 stands on a better footing to that of co-accused Ayush Kumar who has been enlarged on anticipatory bail vide order dated 15.12.2021 passed in Cr. Misc. no. 35623 of 2020.

Having heard learned counsel for the parties and taking into consideration the general and omnibus allegation in the FIR, the petitioner being in custody since 14.9.2021 and grant of anticipatory bail to the above named co-accused, the Court directs the petitioner to be enlarged on bail in connection with Rampur P.S. Case no. 21 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Gaya.
