JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 07-12-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Kamtaul P.S.Case No.101 of 2015 registered under Sections 447, 341, 323, 324, 326, 307 and 504/34 of the Indian Penal Code. In view of direct and specific allegations against the petitioner no.3 Ram Prabodh Sahni that he brought a sword from his house and repeatedly assaulted upon the husband of the informant, I am not inclined to grant him bail. Accordingly, the application of pre-arrest bail of petitioner no.3 Ram Prabodh Sahni is rejected.

No.53281 of 2015 (2) dt.07-12-2015 2/2 So far as petitioners no.1 and 2, namely, Jamuni Devi and Bhoril Sahani are concerned, they are said to be the wife and son of the petitioner no.3 and keeping in mind the allegation made against them, in the event of arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned ACJM, Darbhanga in connection with Kamtaul P.S. Case No.101 of 2015 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
