This is an application for bail in connection with Sessions Trial No. 286 of 2016, arising out of Tarari P.S.Case No. 18 of 2016 registered for the offences under Sections 302, 201 and 120B/34 of the Indian Penal Code.

Allegation against the petitioner is of causing death to his wife.

Submission of learned counsel for the petitioner is that except suspicion there is nothing against him and she fell ill because of abdominal pain and during treatment she died and he is in custody for more than one year.

Heard learned APP also, who has opposed the prayer for bail stating that petitioner has illicit relationship with another

Patna High Court Cr.Misc. No.33624 of 2017 (3) dt.09-08-2017 2/2 lady and, as such, he has killed his wife.

Having heard both sides and considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner.

However, learned District Judge is directed to get the case committed to the court of sessions and thereafter learned trial court is directed to expedite the trial and try to conclude it within nine months and at the same time learned District Judge is directed to monitor the progress of the case.

With the above observation, this application is dismissed.
