ANJANA MISHRA ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody on his remand since 18.4.2016 in connection with Daudnagar P.S. Case No.66 of 2015 registered for the offences under Section 392 of the Indian Penal Code.

It is submitted by the learned counsel for the petitioner that the petitioner was arrested on 09.06.2015 in connection with another case of motorcycle theft, bearing Arwal P.S, Case No. 130 of 2015. Learned counsel for the petitioner further submits that on the alleged date of occurrence, in which he is sought to be roped in, the petitioner is already in custody and his name has been brought in only on the basis of confessional statement

Patna High Court Cr.Misc. No.40199 of 2016 (3) dt.24-11-2016 2/2 made before the police by another co-accused, which has no evidentiary value.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Daudnagar, Aurangabad, in connection with Daudnagar P.S. Case No.66 of 2015.
