JUSTICE BIRENDRA KUMAR ORAL ORDER 21-08-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 304B and 201/34 of the Indian Penal Code.
The daughter of the informant Neha Kumari as well as husband of Neha Kumari committed suicide at one time in the same room. Thereafter, the father of Neha Kumari lodged the present case that Neha was done to death for non-fulfillment of dowry demand.

No.33407 of 2017 (4) dt.21-08-2017 2 /2 Submission of the learned counsel for the petitioners is that the petitioners are also losers of their son and the suicide might have been committed due to some dispute between the two spouses and just to pressurize the family members have been dragged in the case.
The perusal of the case diary would also reveal that the matter was of suicide committed by both the spouses. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.20,000/- (Twenty Thousand) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Patna City/successor Court in connection with By Pass Police Station Case No. 131 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioners shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
