JUSTICE PARTHA SARTHY ORAL ORDER 10-03-2021 Heard learned counsel for the petitioner and learned APP for the State through video conferencing. It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 29.3.2019 passed in Cr. Misc. No.3745 of 2019. In spite of nearly 2 years having passed since the said order, the trial is still continuing and there is no chance of the same concluding in the near future. On merits, it is submitted that at best only strong suspicion has been raised against this petitioner who is in custody since 14.9.2018. The application for bail is opposed by learned APP for the State.

A report had been called for with respect to the stage of trial which has been received. As per report contained in

Patna High Court CR. MISC. No.58543 of 2019(3) dt.10-03-2021 2/2 letter dated 21.10.2020, 8 prosecution witnesses including the Investigating Officer of the case have been examined and only two prosecution witnesses remain to be examined. Having heard learned counsel for the parties and taking into consideration that the trial is near conclusion, the Court is not inclined to enlarge the petitioner on bail and as such the same is rejected.

Learned trial Court is directed to expeditiously conclude the trial.
