JUSTICE MOHIT KUMAR SHAH ORAL ORDER 06-09-2022 The present writ petition has been filed seeking the following relief :- " That this is an application for issuance of a writ in the nature of Mandamus, commanding the respondent nos. 1 to 3 to initiate the proceeding under Public Land Encroachment Act and to take steps for removing the encroachment made by respondent nos. 4 and 5 over public road, situated on Plot no. 4553 of Khata no. 629, which runs connecting the main road Nav Gola, Hassanpur Road to Chhapwa Kotwa Road."

Patna High Court CWJC No.5132 of 2018(4) dt.06-09-2022 2/2 At the outset, the learned counsel for the petitioner seeks liberty on behalf of the petitioner to approach the Circle Officer, Block-Kotwa, District-East Champaran i.e. the respondent no. 3 for redressal of his aforesaid grievance. Liberty so sought, is granted.

It is needless to state that in case, the petitioner files appropriate petition before the respondent no. 3, he shall take appropriate action, expeditiously & in accordance with law. The writ petition stands disposed off on the aforesaid terms.
