JUSTICE ASHUTOSH KUMAR ORAL JUDGMENT Date : 01-06-2020 The petitioner, a superannuated employee of Bihar State Food and Civil Supplies Corporation, has approached this Court for payment of his post-retiral and other dues which have been withheld without any plausible
Patna High Court CWJC No.6901 of 2018 dt.01-06-2020 2/3 reason. The details of the dues of the petitioner have been charted in paragraph-14 of the writ petition, amounting to Rs. 16,87,335/-.
Apart from this, it has also been submitted that the district office of the corporation at Dhanbad has prepared a chart of differential amount of the 6th pay revision from January, 2006 to January, 2009 and April, 2009 to June, 2009 as also from February, 2009 to December, 2009 and January, 2010 to January, 2011. From the aforesaid calculation, it is stated that it would appear that due of differential of 6th pay revision has been calculated and forwarded for payment to the head office of the corporation but the same has not been paid to the petitioner till date. There are other dues about which reference has been made in the writ petition. This Court, under the aforesaid circumstances, directs that in case the petitioner makes a suitable representation before the Managing Director, Bihar State Food and Civil Supplies Corporation, Patna within a period
Patna High Court CWJC No.6901 of 2018 dt.01-06-2020 3/3 of eight weeks, the concerned respondent shall look into the matter, have the facts verified and pass a reasoned order after collecting all information from other centres with respect to the dues of the petitioner. In case the claim of the petitioner is found to be tenable, necessary order in that regard shall be passed and arrangement be made for payment of the dues of the petitioner. This shall be done within a period of eight weeks of the receipt of the representation made by the petitioner.
With the aforesaid direction/observation, the writ petition stands allowed and disposed of.
