NILU AGRAWAL ORAL ORDER 08-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner is languishing in judicial custody since 29.05.2017 in connection with Sono P.S. Case No. 105 of 2017 registered for the offence punishable under Sections 272 and 273 of the Indian Penal Code and Sections 30(a), 41/47 of the Bihar Prohibition and Excise Act, 2016.

The prosecution case, as lodged by the police personnel, is that during course of checking of vehicles, a Tata Indica car was intercepted and the petitioner along with two others was apprehended. From the dicky of the car, 206 litres of country made wine was recovered.

No.35573 of 2017 (2) dt.08-08-2017 2/2 It has been submitted by the learned counsel for the petitioner that he is innocent, bears no criminal history and he was just the driver of the said vehicle. He further submits that nothing has been recovered from his conscious possession and that two other accused, who were passengers in the car, have been granted the privilege of bail by this Court in Cr. Misc. No. 34397 of 2017 on 03.08.2017.

However, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances and the materials on record, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st , Jamui in connection with Sono P.S. Case No. 105 of 2017.
