Earlier the prayer for anticipatory bail of the petitioner had been rejected by this Court, vide order dated15.12.2016 passed in Cr. Misc. No.45317 of 2016 on merit. Submission of the learned counsel for the petitioner is that the petitioner has filed second bail application as the coaccused of this case has already been granted privilege of anticipatory bail by the Bench of this Court but some facts could not be placed at that time, as such his prayer for anticipatory bail was rejected earlier.

Having heard the parties and in view of the facts and circumstances of the case, let the petitioner surrender before the

Patna High Court Cr.Misc. No.38540 of 2017 (2) dt.30-08-2017 2/2 learned court below and make prayer for regular bail, which will be considered on the basis of facts that the another co-accused has been granted anticipatory bail by this Court. Considering these facts, the learned court below will pass appropriate order without being prejudiced by the order of this Court preferably on the same day.
