JUSTICE SHIVAJI PANDEY ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and the State. The petitioner, who is in custody since 22.03.2019, seeks bail in connection with Naya Ram Nagar P.S. Case No.85 of 2019 registered for offence punishable under Sections 147, 148, 149, 307 and 302 of the Indian Penal Code. The allegation against the petitioner including the coaccused is to have assaulted the son of the informant with iron rod resulting in his death.

Counsel for the petitioner submits that there is case and counter case between both the sides for playing the Holi. The deceased was a veteran criminal. There is no specific allegation of assault by iron rod against the petitioner. Considering the nature of allegation, this Court is not inclined to grant bail to the petitioner.

Patna High Court CR. MISC. No.59286 of 2019(3) dt.20-11-2019 2/2 Accordingly, prayer for bail is rejected.
