ANJANA MISHRA ORAL ORDER 27-09-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 26.06.2019 in connection with L.N.M.U. P.S. Case No. 168 of 2019 (G.O. Case No. 548 of 2019), registered for the offence under Sections 272/273/34 of the Indian Penal Code and Section 30(A)(C) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that nothing was recovered from the petitioner, but only on the basis of confessional statement made before the police by a coaccused, the petitioner has been roped in connection with the present case.

In view of the aforementioned facts and circumstances and the petitioner has got no criminal antecedent,

Patna High Court CR. MISC. No.58639 of 2019(2) dt.27-09-2019 2/2 let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned 2nd Additional Sessions Judge-cum-Special Judge (Excise Act), Darbhanga in connection with L.N.M.U. P.S. Case No. 168 of 2019 (G.O. Case No. 548 of 2019).
