2. The petitioner seeks bail in connection with Bithan P.S. Case No. 48 of 2023, registered for the offence under Section 395 of the Indian Penal Code.

3. As per the prosecution case, dacoits looted a motorcycle and Rs. 50,000/- cash from the informant.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. The name of the petitioner transpired in the self- inculpatory statement of the co-accused Nitish Kumar. The petitioner has no criminal antecedent.

5. Considering the aforesaid facts and circumstances of the case, this Court is not inclined to grant bail to this

6. Accordingly, the application for anticipatory bail is dismissed.

7. The petitioner is directed to surrender within four weeks, failing which the Superintendent of Police, Samastipur will take all coercive steps for his arrest.
