The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 302 and 328/34 of the IPC.

Patna High Court CR. MISC. No.58963 of 2019(3) dt.16-11-2019 2/3 It is alleged against the petitioners that they administered toddy mixing with poison to the father of the informant, who subsequently died.

It is submitted by learned counsel for the petitioners that only on the basis of suspicion, the accusation has been levelled against the petitioners and postmortem of the deceased has not been conducted. A statement has been made in paragraph no.3 of the petition that the petitioner is not having any criminal antecedent.

Learned APP, after going through the case diary, submits that the accusation against the petitioners is specific and they are named in the FIR.

Considering the suspicious nature of accusation, coupled with the statement made in paragraph no.3 of the petition that the petitioners are not having any criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest/surrender before the learned Court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of like amount each to the satisfaction of learned CJM, Nawada in connection with Rajauli P.S. Case No. 206 of 2019, subject to the condition as laid down under Section
