JUSTICE RAKESH KUMAR ORAL ORDER 13-12-2016 Heard Sri Raj Kumar, learned counsel for the petitioners and Smt. Sahin Begam , learned Additional Public Prosecutor.

Petitioners, who are father -in- law and mother- inlaw of the complainant/ opposite party no. 2 have approached this court for grant of anticipatory bail in Nawada Complaint Case No. 93 of 2015 registered for the offence under Section 498(A) of the Indian Penal Code .

By way of referring to the statement made in the supplementary affidavit filed on behalf of the petitioners it has been indicated that husband of the opposite party no. 2 has

Patna High Court Cr.Misc. No.47772 of 2016 (5) dt.13-12-2016 2/2 already surrendered and he is in custody . He further submits that except general and omnibus allegation there is no specific accusation against the petitioners.

Keeping in view the fact that husband of the complainant has already surrendered and in custody, there is no reason to deny the prayer for grant of anticipatory bail to the petitioners. Accordingly, in the event of arrest or surrender within a period of six weeks from today, let both the petitioner Devnandan Prasad Yadav @ Devnandan Prasad and Jaymanti Devi be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Nawada / concerned court in connection with Nawada Complaint Case No. 93 of 2015 subject to the conditions as contemplated under Section 438(2) of the Code of Criminal Procedure , 1973.
