JUSTICE RAJEEV RANJAN PRASAD) 19-09-2025 There are some serious allegations against the Shahpur Police Station in the district of Patna. The petitioner claims that he and Kriti Suman (the corpus) are major and they have married with their own will and volition. The marriage was not liked by the family members of Kriti Suman who are Respondent Nos. 6 to 8.

2. It is further stated that on 20.08.2025, the Shahpur

WJC No.2539 of 2025(2) dt.19-09-2025 2/3 Police called the petitioner and his wife, namely, Kriti Suman at the police station in the name of inquiry where they told the petitioner about a complaint received from Jharkhand Police. Thereafter, the petitioner and Kriti Suman were separated and while the petitioner was put in a separate cell, he could not get any information as to where his wife was kept. It is then stated that on 21.08.2025 at 01:00 PM, the petitioner was though released, his wife Kriti Suman (the corpus) has been handed over to Jharkhand Police but in this regard nothing has been provided to the petitioner. It is specifically stated that Respondent No. 5 i.e. the Station House Officer, Shahpur Police Station, Patna has illegally assisted the private respondents.

3. Issue notice to the Respondent Nos. 6 to 8 through both by ordinary process as well as under registered cover with A/D for which requisites etc. must be filed by tomorrow.

4. The Office shall issue notice forthwith.

5. Let the matter be brought to the notice of the Senior Superintendent of Police, Patna who will verify the facts, particularly, the allegations against the Station House Officer, Shahpur Police Station, Patna.

6. A counter affidavit be filed on behalf of the State respondents by 24th September, 2025.

7. We also direct the Senior Superintendent of Police, Patna and the Station House Officer, Shahpur to produce the corpus before this Court on 25th September, 2025 in Chambers at 02:15 PM.

8. The order shall be communicated to the Senior Superintendent of Police, Patna forthwith.

Later on

9. After the aforesaid order was already passed, the matter was mentioned by learned counsel for the petitioner and it has been informed that he has instruction to withdraw this writ application.

10. In the circumstances brought to our notice and the prayer made by learned counsel for the petitioner, we permit him to withdraw this writ application. The order recorded in paragraphs '3' to '8' above shall not be given effect to.

11. The writ application is, therefore, dismissed as withdrawn.
