The petitioner being the own brother of the deceased is apprehending his arrest in connection with Siwan Muffasil P.S. Case No. 486 of 2014 registered for the offences punishable under Sections 323, 302 and 120B of the Indian Penal Code. Earlier case diary of the present case was called for which has since been received.
Learned counsel for the petitioner submits that though original complaint case has been lodged against the petitioner under Section 302 of the Indian Penal Code, but later on after investigation, the charge sheet was submitted under Section 306 of the Indian Penal Code. It is further submitted that an U.D. Case
Patna High Court Cr.Misc. No.54786 of 2015 (3) dt.04-01-2016 had also been registered in connection with the present case. Considering the nature of allegation made and that there is no cogent material in the case diary so as to implicate the petitioner in the present case, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Siwan in connection with Siwan Mufassil P.S. Case No. 486 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
