1. Heard the learned counsel for the petitioner and learned counsel for the State.

2. The petitioner seeks bail in connection with Bisfi (Patauna) P.S. Case No. 191 of 2023 registered for the offence under Sections 272, 273, 420, 467, 468, 471, 120(B) of the Indian Penal Code and Section 30(a)/36/38(I)/41(I) of the Bihar Prohibition and Excise Act.

3. Recovery is of total 1523.880 litres of illicit liquor.

4. Learned counsel for the petitioner submits that the petitioner is in custody since 26.07.2023.

5. Learned counsel for the petitioner further submits that the petitioner has offered to deposit Rs. 25,000/- in Ram Krishna Mission Sevashrama, Swami Vivekanand Path,

Patna High Court CR. MISC. No.68007 of 2023(2) dt.18-10-2023 2/2 Bela, Muzaffarpur, Bihar - 842002.

6. Considering the period of custody and recovery of liquor, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional Sessions Judge-cum-Special Judge, Excise Act, Madhubani in connection with Bisfi (Patauna) P.S. Case No. 191 of 2023.

8. The petitioner will visit Rahika Police Station on the first Sunday of each month. Any default in appearance at the Police Station would result in cancellation of bail bond of the petitioner.

9. Petitioner's bail bond shall be accepted only after he produces the receipt of deposit amount issued by Ram Krishna Mission Sevashrama, Swami Vivekanand Path, Bela, Muzaffarpur, Bihar - 842002.
