The petitioners apprehend their arrest in connection with Patepur P.S. Case no. 12 of 2016, registered under Sections 341, 323, 324, 379, 307, 504 and 506 of the Indian Penal Code. The accusation is that in course of occurrence Abhishek Kumar gave sword blow on Sopendra Kumar, but he succeeded to flee away and Upendra Kumar sustained injury on his head. At that time, Sanjit Kumar, petitioners Mausham Kumar, Vicky Kumar caused injury through butt to Guddu Kumar. Further allegation is that accused Vicky Kumar and petitioner Mausham Kumar took out case of Rs. 40,000/- from the cash box of the shop of informant and they also took out clothes worth of Rs. 50,000/-.
Learned counsel for the petitioners submits that
Patna High Court Cr.Misc. No.44167 of 2016 (2) dt.21-10-2016 2/2 allegation has been made against petitioner Vicky and Mausam Kumar to cause injury to Sanjit Kumar and Guddu Kumar through butt of pistol with further allegation to causing injury to Sanjit Kumar by petitioner Kundan Kumar and Chhotu Kumar, but no grievous injury was sustained by Sanjit Kumar and Guddu Kumar. Moreover, the parties have compromised this case out of the Court. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur in connection with Patepur P.S. Case No.12 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C. (Rajendra Kumar Mishra, J) manish/- U T
