JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 03-08-2017 Inter alia, contending that there are encroachment in Government property detailed in para-1 of the writ petition and on complaint made by the Education Department, vide Annexure-8 on 8.1.2015, a request was made to the Circle Officer, Jale Anchal, Darbhanga, Respondent No. 9 to take action for removal of the encroachment but till date nothing has been done even after a period of two years have passed, this petition has been filed in

Patna High Court CWJC No.10691 of 2017 (2) dt.03-08-2017 2/2 public interest.

Keeping in view the averments made in the writ petition and the facts as are made by the documents Annexures 8 and 9, we direct that on the petitioner's filing a certified copy of this order along with the relevant documents, the Respondent No. 9, the Circle Officer concerned, the statutory authority under the Bihar Public Land Encroachment Act, shall register a case and proceed to remove the encroachment in accordance with law after hearing all concerned and conclude it preferably within a period of six months from the date of receipt of this order. With the aforesaid, the writ petition stands disposed of.
