JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 Earlier the prayer for bail of the petitioner was dismissed vide order dated 14.11.2017 passed in Cr. Misc. No. 53061 of 2018 and allegation against the petitioner is of firing on the deceased causing his death.

Submission of learned counsel for the petitioner is that he has been in judicial custody for last two years and there is no likelihood of conclusion of trial in near future. Heard learned A.P.P. also.

Earlier a report was called for from the Trial Court, which has since been received, it appears that in this case out of six witnesses, four witnesses have already been examined and evidence is going on.

In view of the above facts, I am not inclined to

Patna High Court CR. MISC. No.58624 of 2019(3) dt.23-10-2019 2/2 enlarge the petitioner on bail. However, considering the fact that petitioner has been in judicial custody for last two years, the Trial Court is directed to expedite the trial and conclude the same as soon as possible.

This application is accordingly dismissed.
