JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 11-08-2017 Heard the learned counsel for the petitioner as well as the learned A.P.P. for the State.

In this application for anticipatory bail the petitioner apprehends his arrest in connection with Mirganj P.S. Case No. 75 of 2017/ G.R. No. 941 of 2017 for the offences punishable under sections 414 and 34 of the I.P.C.

Allegedly, three persons were apprehended and one person succeeded in fleeing away and the apprehended accused persons stated the name of the petitioner that he used to give stolen motorcycles to them.

Submission is of false implication and that nothing has been recovered from possession of the petitioner, as a matter of fact the petitioner is trained labour of a reputed Gold Smith in

Patna High Court Cr.Misc. No.35154 of 2017 (2) dt.11-08-2017 2/2 Mirganj Town and near about one year before accused Rakesh Kumar Soni took one lakh rupees from the petitioner as loan but till today he did not return a single farthing and due to demand being made he has implicated the petitioner only with a view to grab money.

The learned A.P.P. submits that the apprehended accused persons have disclosed the name of the petitioner at once. In the facts and circumstances as stated above, considering that besides the confessional statement of co-accused there is no other legal and tangible material against the petitioner and as such the petitioner, in case of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of. A.C.J.M-XVI, Gopalganj in connection with above mentioned case, subject to the conditions as laid down in section 438 (2) of the Cr.P.C.
