JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks regular bail in connection with Deodha P.S. Case No. 04 of 2017, registered for offences punishable under Sections 324 and 307 of Indian Penal Code. Allegation against the petitioner is of firing causing injury in the hand of the of the informant.

It has been submitted on behalf of the petitioner that occurrence took place in the heat of the moment and had there been intention to kill the informant, he would have repeated the firing, however, the injuries caused to the informant is not on vital part of his body. Petitioner has been in judicial custody since 21.03.2017 and has no criminal antecedent.

Learned counsel for the State opposed the prayer for bail. Having heard both sides, considering the fact and

No.33745 of 2017 (3) dt.03-08-2017 circumstances coupled with the fact that injuries caused to the informant is found to be grievous in nature, as such, at this stage, I am not inclined to release the petitioner on bail, his application for regular bail is, accordingly, rejected.

However, the petitioner may renew his prayer for bail after framing of charge in this case.
