JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-08-2017 The petitioner seeks bail in connection with Nokha P.S. Case No. 46 of 2017 registered for the offences punishable under sections 272, 273, 120(B) of the Indian Penal Code and Section 30 of Bihar Excise Act, 2016.
Allegation against the petitioner is that huge quantity of liquor was recovered from the vehicle.
Learned counsel for the petitioner submitted that nothing has been recovered from the possession of the petitioner and he has no criminal antecedent. He is in custody for more than one month.
Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances of the case, I am not inclined to grant bail to the
Patna High Court Cr.Misc. No.34953 of 2017 (2) dt.03-08-2017 petitioner. However, the petitioner may renew prayer for bail after framing of charge or after completion of three months in custody in this case.
