====================================================== CORAM: HONOURABLE JUSTICE SMT. ANJANA MISHRA ORAL ORDER 20-11-2019 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner is apprehending his arrest in connection with Bhagalpur Mahila P.S. Case No. 9 of 2018 for the offence registered under Sections 498A, 323, 324 of the Indian Penal Code and 3, 4 of Dowry Prohibition Act.

The petitioner is husband in a case for the offence registered under Section 498A of the Indian Penal Code. Allegation against the present petitioner is of torture and demand of dowry.

Learned counsel for the petitioner submits that the entire allegation is false and fictitious and has been initiated on

Patna High Court CR. MISC. No.60741 of 2019(4) dt.20-11-2019 2/2 account of local village politics. He further submits that no specific allegation has been made against the petitioner and the informant is never ready to stay with the petitioner. Considering the aforementioned facts and circumstances and the petitioner has clean antecedent, let the petitioner, above named, in the event of his arrest or surrender before the court below within four weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount to the satisfaction of learned Sub Divisional Judicial Magistrate, Bhagalpur, in connection with Bhagalpur Mahila P.S. Case No. 9 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
