The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 325, 307, 384, 506/34 of the Indian Penal Code. The prosecution case is that the accused persons assaulted the informant indiscriminately when son of the informant namely, Govind Prasad, came to rescue then he was also assaulted by co-accused Dhanji Chaudhary with 'lathi' causing fracture injury on his ribs whereas co-accused Manjesh Chaudhary and petitioner no.3 Upendra Choudhary pressed the neck of the son of the informant.
It is submitted by learned counsel for the petitioners
Patna High Court Cr.Misc. No.56231 of 2015 (2) dt.10-12-2015 2/2 that the accusation is omnibus and general when the specific accusation is against co-accused Shobhnath Chaudhary and Dhanji Chaudhary. Moreover, A statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.
Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned SDJM, Bikramganj, Rohtas at Sasaram in connection with Sanjhauli P.S. Case No.77 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
