JUSTICE BIRENDRA KUMAR ORAL ORDER 19-12-2016 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 341, 323, 324, 379 and 354, 504/34 of the Indian Penal Code and Section 8/9 of the Protection of Children from Sexual Offences Act, (POCSO) It appears that co-accused Md. Nawaz has already been allowed anticipatory bail by a Co-ordinate Bench of this Court in Cr. Misc. No. 51375 of 2016 against whom there was allegation that Md. Nawaz along with Md. Ibran brought the daughter of the informant at the door and threatened to demolish her prestige. There is allegation of commission of theft also.

No.50928 of 2016 (3) dt.19-12-2016 ` 2/2 Considering the aforesaid fact as well as the fact that the petitioners are female, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur/Successor Court in connection with Saraiya Police Station Case No. 01 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
