The petitioner is languishing in custody for the offence punishable under Section 302/34 of the Indian Penal Code.

There is general and omnibus allegation that all the accused persons with intent to commit murder of the brother of the informant pushed him from the roof and thereafter all reached at the house and assaulted brutally to the victim as a result whereof he died.

Submission is that similarly situated some other coaccused were allowed anticipatory bail by a coordinate Bench of this Court. Allegation is general and omnibus against the

Considering the aforesaid facts, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with S.T. No.55 of 2019/73 of 2019, arising out of Barabar Prayatak (Bishunganj O.P.) P.S. Case No.92 of 2018, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
