JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-12-2015 The petitioner has renewed his prayer for anticipatory bail in a complaint case wherein process has been directed to be issued after cognizance being taken for the offences punishable under Sections 406, 454, 379, 506, 504, 323, 341 and 385/34 of the IPC. Earlier anticipatory bail application of the petitioner was rejected vide Cr. Misc. No.19572 of 2014 by a co-ordinate Bench of this Court with liberty to the learned court below to consider the prayer for regular bail of the petitioner if the petitioner surrenders within a fortnight, thereafter, the petitioner renewed his prayer for anticipatory bail vide Cr. Misc. No. 10212 of 2015 but the same was also disposed of by the same Bench.

It is submitted by learned counsel for the petitioner that the prayer has been renewed on the ground that the petitioner was not aware of the fact that earlier bail application was heard by this

Patna High Court Cr.Misc. No.56181 of 2015 (2) dt.10-12-2015 2/2 Court on 16.10.2014 when non-bailable warrant was already issued on 02.04.2014, though, the co-accused was granted anticipatory bail by the same co-ordinate Bench vide 12965 of 2014.

In the circumstance, this Court is not inclined to interfere.

The aforesaid facts constitute good ground for consideration of prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Complaint Case No. 2003 of 2011 pending in the court of learned CJM, Bhagalpur.

Accordingly, the application is disposed of.
