2. The petitioner apprehends his arrest in connection with Daraunda P.S. Case No. 53 of 2023, registered for offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
3. As per FIR, 20 litres of illicit liquor has been recovered from the house of the petitioner.
4. It is submitted on behalf of learned counsel for the petitioner that the petitioner has falsely been implicated in this case. The said liquor has been recovered from the joint house of the petitioner and he has no concern with the seized liquor.
5. Learned APP however vehemently opposed the prayer for bail.

In view of the fact that prima facie a case under the Excise Act, is made out against the petitioner, this application for grant of anticipatory bail is not maintainable in view of the Full Bench decision of this Court rendered in the case of Ram Vinay Yadav Vs. The State of Bihar, reported in 2019 (2) PLJR 1089.
7. Accordingly, this anticipatory bail application is dismissed as not maintainable.
