2. The petitioner has filed the instant application for modification of the order dated 23.09.2022 passed in Cr. Misc. No. 37881 of 2022, whereby while granting bail to the petitioner in connection with Garbandanga P.S. Case No. 29 of 2018 the petitioner was directed to surrender in the Court below within a period of four weeks.

3. It is submitted by learned counsel for the petitioner that due to communication gap message of bail, the information regarding grant of anticipatory bail could not be communicated on time and accordingly, the period of surrender has expired. Hence, the petitioner prays for extension of surrender period.

4. It appears from order dated 23.09.2022, that petitioner was granted anticipatory bail and he did not comply with the order for more than one year.

5. In view of the causal approach adopted by the petitioner, in complying with the order of this Court and there is huge misuse of bail, I am not inclined to grant further extension of period for surrender.

6. Modification application stands rejected.
