JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-11-2016 Heard Mr. Umesh Chandra Verma, counsel for the petitioner and Mr. Anuj Kumar Srivastava, APP for the State. The petitioner, apprehending his arrest in Harsidhi P.S. case No.270 of 2016 registered under Sections 272 and 273 I.P.C. and 49, 47, 50, 51 and 53 of Bihar Excise Amendment Act, 2016, prays for grant of anticipatory bail.

The police got an information that the petitioner was involved in clandestine sale of liquor. A raid was conducted of the house of the petitioner. Seeing the police the accused persons including the petitioner fled away. In presence of independent witness, 6 liters raw spirit, kept in 3 spirit bottles, were recovered behind the house of the petitioner.

Considering the statements made in the bail application

Patna High Court Cr.Misc. No.47739 of 2016 (2) dt.19-11-2016 2/2 and the other materials reflected from the record, in my view, this is not a fit case for grant of anticipatory bail. The prayer is rejected.
