Petitioner is an accused in a case registered for the offence punishable under sections 302/120B/201 of the IPC. It is alleged by the informant that the petitioner and his family members were in habit of committing cruelty on his sister who was married to the petitioner 12 years back. Suddenly, on 28.3.2019 they killed his sister and her three children by administering them poison.

Learned counsel for the petitioner submits that the allegation is based on suspicion. Petitioner is in custody since 16.4.2019. There is no eye witness to the occurrence. Police after investigation found the case to be true under section 306 of the IPC. Even in the post mortem report, no external injury has been found on the body of the deceased.

In view of the nature of allegation against the petitioner and the fact that petitioner is husband of the deceased, his prayer for bail is rejected.
